AVIATION AMENDMENT ACT NO. 64 OF 1980 [ASSENTED TO 6 MAY, 1980][DATE OF COMMENCEMENT TO BE PROCLAIMED] (English text signed by the State President) ACT To amend the provisions of the Aviation Act, 1962, so as to enable the Minister of Transport Affairs to provide by regulation for the disposal of certain vehicles left under certain circumstances on the premises of certain aerodromes; and to provide for incidental matters. 1. Amendment of section 22 of Act 74 of 1962, as amended by section 5 of Act 12 of 1965, section 3 of Act 83 of 1969 and section 25 of Act 62 of 1973.—Section 22 of the Aviation Act, 1962, is hereby amended by the substitution for subparagraph (ii) of paragraph (e) of subsection (1) of the following subparagraph: “(ii)the prohibition or the regulation of vehicular or other traffic within such aerodrome, including— (aa)the parking of vehicles therein, the demarcation of places, and the imposition of fees, for such parking and the manner of payment of such fees; (bb)the circumstances in which and the persons by whom it may be decided whether any vehicle parked within such aerodrome has been abandoned; (cc)the steps to be taken to trace the owner or possessor of or any other person having an interest in such vehicle; (dd)the storage, removal, sale or any other manner of disposal of such vehicle; (ee)the liability of such owner, possessor or other person for any costs relating to the abandonment of any such vehicle, the tracing of such owner, possessor or other person and the storage, removal, sale or any other manner of disposal of such vehicle, and the manner in which such costs may be recovered from such owner, possessor or other person; (ff)the utilization of the proceeds of the sale or any other manner of disposal of such vehicle and the circumstances in which such proceeds may be utilized to defray the costs referred to in subparagraph (ee); (gg)the circumstances in which the State and its officials and employees shall not be liable for loss of or damage to or relating to any vehicle parked within such aerodrome, and the meaning of the word ‘parked’ for the purposes of this subparagraph;”. 2. Short title and commencement.—This Act shall be called the Aviation Amendment Act, 1980, and shall come into operation on a date fixed by the State President by proclamation in the Gazette.
