BLACK TRANSPORT SERVICES AMENDMENT ACT NO. 76 OF 1982 [ASSENTED TO 1 JUNE, 1982][DATE OF COMMENCEMENT: 31 OCTOBER, 1982] (Afrikaans text signed by the State President) ACT To amend the Black Transport Services Act, 1957, so as to substitute certain definitions and expressions; to make other provision regarding the application of the Act; to make further provision regarding the powers of the Minister to determine the scale of contributions; to make the provisions of the Act applicable in respect of domestic servants and Blacks for whom their employer provides approved accommodation; to make other provision for the payment of moneys and the application thereof; to delete references to the Senate; and to provide that the Minister may enter into an agreement with any state or territory; and to provide for matters connected therewith. 1. Amends section 1 (1) of the Black Transport Services Act, No. 53 of 1957, as follows:—paragraph (a) substitutes in the definition of “employer” the words “Transport Services” for the words “Railways and Harbours Administration”; paragraph (b) substitutes the definition of “Minister”; and paragraph (c) substitutes paragraph (b) of the definition of “urban local authority”. 2. Substitutes section 2 of the Black Transport Services Act, No. 53 of 1957. 3. Amends section 3 of the Black Transport Services Act, No. 53 of 1957, as follows:— paragraph (a) substitutes subsection (1); and paragraph (b) deletes subsection (2). 4. Amends section 5 of the Black Transport Services Act, No. 53 of 1957, as follows:— paragraph (a) substitutes the words “Co-operation and Development” for the words “Plural Relations and Development”, wherever they occur; and paragraph (b) deletes subsection (4). 5. Amends section 7 of the Black Transport Services Act, No. 53 of 1957, as follows;— paragraph (a) substitutes subsection (1); and paragraph (b) deletes subsection (7). 6. Amends section 8 of the Black Transport Services Act, No. 53 of 1957, by deleting the words “Controller and”, wherever they occur. 7. Inserts section 8A in the Black Transport Services Act, No. 53 of 1957. 8. Amends section 9 of the Black Transport Services Act, No. 53 of 1957, as follows:— paragraph (a) substitutes in subsection (1) in the words following on paragraph (d) the words “two hundred rand” for the words “one hundred pounds”; paragraph (b) substitutes in subsection (2) (a) the words “one rand” for the words “ten shillings”; paragraph (c) substitutes in subsection (2) (b) the words “twenty rand” for the words “ten pounds”; and paragraph (d) amends the Afrikaans text. 9. Amends section 10 of the Black Transport Services Act, No. 53 of 1957, by substituting subsection (2). 10. Inserts section 10A in the Black Transport Services Act, No. 53 of 1957. 11. Substitution of words “Secretary” and “Secretary for Transport” in Act 53 of 1957.—The principal Act is hereby amended by the substitution for the words “Secretary” and “Secretary for Transport”, wherever they occur, of the words “Director-General” and “Director-General: Transport”, respectively. 12. Short title and commencement.—This Act shall be called the Black Transport Services Amendment Act, 1982, and shall come into operation on a date fixed by the State President by proclamation in the Gazette.
