INTERNATIONAL AIR SERVICES AMENDMENT ACT

ACT

To amend the International Air Services Act, 1993, so as to 
amend certain definitions and to define certain expressions; to 
further regulate the operation of an international air service; to 
extend the conditions under which a licensee has to apply for 
the amendment of a licence; to further regulate the processing of 
a licence and permit; to further regulate the adjudication of an 
application for a licence or amendment thereof; to extend the 
conditions under which a licence is issued; to further regulate 
the duties of a licensee; to extend the conditions upon which a 
permit is issued; to provide for the approval of an operations 
manual; to further regulate certain offences and penalties; and 
to extend the power of the Minister to make regulations; and to 
provide for matters connected therewith.

1.   Amends section 1 of the International Air Services Act, No. 
60 of 1993, as follows:—paragraph (a) substitutes paragraph (a) 
(ii) of the definition of “airport”; paragraph (b) inserts the 
definitions of “authorized officer” and “close corporation”; 
paragraph (c) inserts the definition of “company”; paragraph (d) 
inserts the definition of “inspector”; paragraph (e) substitutes 
the definition of “licence”; paragraph (f) substitutes the 
definition of “licensee”; and paragraph (g) substitutes the 
definition of “operating certificate”.

2.   Amends section 13 of the International Air Services Act, 
No. 60 of 1993, as follows:—paragraph (a) substitutes 
subsection (1); and paragraph (b) adds subsections (7), (8) and 
(9).

3.   Amends section 15 of the International Air Services Act, 
No. 60 of 1993, as follows:— paragraph (a) inserts subsection 
(2A); and paragraph (b) adds subsection (4).

4.   Amends section 16 of the International Air Services Act, 
No. 60 of 1993, by substituting subsection (3) (date of 
commencement 15 April, 1994).

5.   Amends section 17 of the International Air Services Act, 
No. 60 of 1993, as follows:—paragraph (a) inserts subsection 
(3) (aA); paragraph (b) substitutes subsection (10); and 
paragraph (c) adds subsection (14).

6.   Amends section 22 of the International Air Services Act, 
No. 60 of 1993, by substituting subsection (1).

7.   Amends section 23 of the International Air Services Act, 
No. 60 of 1993, by substituting subsection (1).

8.   Amends section 24 of the International Air Services Act, 
No. 60 of 1993, by substituting subsection (3) (date of 
commencement 1 April, 1994).

9.   Amends section 25 (3) of the International Air Services Act, 
No. 60 of 1993, by substituting paragraph (a) in the Afrikaans 
text.

10.   Amends section 28 (1) of the International Air Services 
Act, No. 60 of 1993, by deleting the word “and” at the end of 
paragraph (b) and adding paragraph (d).

11.   Substitutes section 30 of the International Air Services Act, 
No. 60 of 1993 (date of commencement 15 April, 1994).

12.   Amends section 40 of the International Air Services Act, 
No. 60 of 1993, as follows:—paragraph (a) substitutes 
subsection (1) (e); paragraph (b) inserts subsection (1) (eA); 
paragraph (c) adds subsection (1) (g); and paragraph (d) 
substitutes subsection (2) (b).

13.   Amends section 43 (1) of the International Air Services 
Act, No. 60 of 1993, by inserting paragraphs (fA), (fB), (fC), 
(fD) and (fE) (date of commencement 1 April, 1994).

14.   Short title and commencement of certain provisions.—This 
Act shall be called the International Air Services Amendment 
Act, 1996, and sections 4, 8, 11 and 13 shall be deemed to have 
come into operation on 15 April 1994.
