LEGAL SUCCESSION TO THE SOUTH AFRICAN 
TRANSPORT SERVICES AMENDMENT ACT

ACT

To amend the Legal Succession to the South African Transport 
Services Act, 1989, so as to define or further define certain 
expressions and to delete a definition; to rectify certain outdated 
references and wrong cross-references; to authorize the Minister 
of Transport to issue directives clarifying, elaborating upon or 
giving specific content to the objectives of the South African 
Rail Commuter Corporation Limited; to further regulate the 
constitution of the Board of Control of the Corporation; to 
compel the Board of Control of the Corporation to take into 
consideration the said directives in the management of the 
Corporation; to extend the matters in respect of which the 
Minister may make regulations; and to provide that the Minister 
may on his own initiative declare any provision of the 
Companies Act, 1973, applicable to the Corporation; and to 
provide for incidental matters.

1.   Amends section 1 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989, as follows:—
paragraph (a) inserts the definition of “local government body”; 
paragraph (b) deletes the definition of “regional services council 
“; and paragraph (c) substitutes the definition of “transport 
authority”.

2.   Amends section 14 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989, by substituting 
subsection (4).

3.   Amends section 23 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989, as follows:—
paragraph (a) substitutes subsection (1); paragraph (b) 
substitutes the words preceding subsection (5) (a); paragraph (c) 
substitutes subsection (5) (j); and paragraph (d) adds subsection 
(6).

4.   Amends section 24 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989, as follows:—
paragraph (a) substitutes subsection (1); paragraph (b) inserts 
subsection (2) (bA); and paragraph (c) adds subsection (7).

5.   Amends section 25 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989, by substituting 
subsection (3).

6.   Substitutes section 30 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989.

7.   Amends section 31 of the Legal Succession to the South 
African Transport Services Act, No. 9 of 1989, as follows:—
paragraph (a) substitutes subsection (1); and paragraph (b) 
substitutes subsection (3).

8.   Short title.—This Act shall be called the Legal Succession 
to the South African Transport Services Amendment Act, 1992.
