MERCHANT SHIPPING AMENDMENT ACT

ACT

To amend the Merchant Shipping Act, 1951, so as to further 
define the functions of certain officers in relation to the crews of 
ships; to further regulate the disposal of wages payable to 
seamen; and to provide for the application in the Republic of 
conventions relating to merchant shipping matters; and to 
provide for matters connected therewith.

1.   Amends section 2 (1) of the Merchant Shipping Act, No. 57 
of 1951, as follows:— paragraph (a) substitutes the definition of 
“collision regulations”; and paragraph (b) substitutes the 
definition of “International Collision Regulations Convention” 
for the definition of “International Collision Regulations”.

2.   Amends section 86 of the Merchant Shipping Act, No. 57 of 
1951, by deleting subsection (1).

3.   Amends section 90 of the Merchant Shipping Act, No. 57 of 
1951, by substituting subsection (2).

4.   Amends section 97 of the Merchant Shipping Act, No. 57 of 
1951, by deleting paragraphs (b) and (c) and the proviso.

5.   Amends section 103 of the Merchant Shipping Act, No. 57 
of 1951, as follows:— paragraph (a) substitutes paragraphs (a), 
(b), (c), (d) and (e); and paragraph (b) substitutes paragraph (h).

6.   Amends section 104 (1) of the Merchant Shipping Act, No. 
57 of 1951, by substituting paragraphs (a) and (b).

7.   Amends section 105 of the Merchant Shipping Act, No. 57 
of 1951, by substituting subsection (1).

8.   Amends section 106 of the Merchant Shipping Act, No. 57 
of 1951, by substituting paragraph (b).

9.   Amends section 112 of the Merchant Shipping Act, No. 57 
of 1951, by substituting subsection (6).

10.   Substitutes section 113 of the Merchant Shipping Act, No. 
57 of 1951.

11.   Amends section 115 of the Merchant Shipping Act, No. 57 
of 1951, by substituting subsection (2).

12.   Amends section 122 (a) of the Merchant Shipping Act, No. 
57 of 1951, by substituting the words preceding the proviso.

13.   Amends section 124 (1) of the Merchant Shipping Act, 
No. 57 of 1951, by substituting the first sentence.

14 and 15.   Substitute respectively sections 125 and 128 of the 
Merchant Shipping Act, No. 57 of 1951.

16.   Amends section 130 of the Merchant Shipping Act, No. 57 
of 1951, as follows:— paragraph (a) substitutes subsection (1); 
and paragraph (b) substitutes subsection (5).

17.   Amends section 153 of the Merchant Shipping Act, No. 57 
of 1951, by substituting subsection (4).

18.   Substitutes section 185 of the Merchant Shipping Act, No. 
57 of 1951.

19.   Amends section 356 of the Merchant Shipping Act, No. 57 
of 1951, as follows:— paragraph (a) substitutes subsection (2) 
(b); paragraph (b) adds the word “and” to subsection (2) (c); 
paragraph (c) inserts subsection (2) (d); paragraph (d) 
substitutes subsection (3); paragraph (e) substitutes in 
subsection (5) the words preceding the proviso; and paragraph 
(f) deletes subsection (7).

20.   Substitutes section 356bis of the Merchant Shipping Act, 
No. 57 of 1951.

21.   Short title and commencement.—(1)  This Act shall be 
called the Merchant Shipping Amendment Act, 1982, and shall 
come into operation on a date fixed by the State President by 
proclamation in the Gazette.

(2)  Different dates may be fixed under subsection (1) in respect 
of different provisions of this Act.
