NATIONAL ROADS AMENDMENT ACT NO 100 OF 1992 [ASSENTED TO 18 JUNE, 1992][DATE OF COMMENCEMENT: 1 July, 1992] (Unless otherwise indicated) (English text signed by the State President) ACT To amend the National Roads Act, 1971, so as to insert, amend or delete certain definitions; to empower the Board to redeem certain loans; to regulate the construction of interprovincial bridges; to provide for the transfer of certain powers regarding national roads within townships to local authorities; to further regulate the expropriation of land; to further regulate the declaration of toll roads; to provide for the application of a rebuttable legal presumption in certain criminal proceedings; to further regulate trading on national roads; to increase fines; to further regulate the lodging of appeals; and to substitute certain obsolete expressions; and to provide for matters connected therewith. 1. Amends section 1 of the National Roads Act, No. 54 of 1971, as follows:—paragraph (a) substitutes the definition of “Administrator”; paragraph (b) substitutes the definition of “building restriction area”; paragraph (c) inserts the definition of “Board”; paragraph (d) deletes the definition of “commission”; paragraph (e) inserts the definition of “interprovincial bridge” and “interstate bridge”; paragraph ( f ) deletes the definition of “junction”; paragraph (g) substitutes the definition of “local authority”; paragraph (h) substitutes the definition of “officer”; paragraph (i) substitutes the definition of “point of intersection”; paragraph (j) substitutes the definition of “road traffic law”; paragraph (k) inserts the definition of “this Act”; paragraph (l) inserts the definition of “toll gate”; and paragraph (m) substitutes the definition of “toll road”. 2. Amends section 2 of the National Roads Act, No. 54 of 1971, as follows:—paragraph (a) substitutes subsection (3) (a) and (b); paragraph (b) substitutes subsection (3A); paragraph (c) substitutes subsection (8); and paragraph (d) substitutes subsection (9). 3. Amends section 4 of the National Roads Act, No. 54 of 1971, by substituting subsection (2). 4. Amends section 2 of the National Roads Act, No. 54 of 1971, as follows:—paragraph (a) deletes subsection (1) (aA); paragraph (b) substitutes subsection (1) (b) and (c); paragraph (c) inserts subsection (1) (cA); paragraph (d) substitutes subsection (1) ( f ); paragraph (e) substitutes subsection (1) (l); paragraph ( f ) substitutes subsection (1) (m); and paragraph (g) substitutes subsection (2). 5. Amends section 6 of the National Roads Act, No. 54 of 1971, as follows:—paragraph (a) inserts subsection (2A); and paragraph (b) substitutes subsection (3) (a). 6. Amends section 8 of the National Roads Act, No. 54 of 1971, by substituting subsection (1). 7. Amends section 9 of the National Roads Act, No. 54 of 1971, as follows:—paragraph (a) substitutes subsection (1) (a) and (b); paragraph (b) substitutes subsections (2), (3) and (4); paragraph (c) inserts subsection (4A); and paragraph (d) substitutes subsection (5) (date of commencement 1 October 1992). 8. Amends section 10 of the National Roads Act, No. 54 of 1971, by substituting subsection (5). 9. Amends section 15 of the National Roads Act, No. 54 of 1971, as follows:—paragraph (a) substitutes subsection (1) (date of commencement 1 October 1992); and paragraph (b) substitutes the words preceding subsection (3) (a); and subsection (3) (a). 10. Amends section 22 of the National Roads Act, No. 54 of 1971, by substituting the expressions “R4 000” and “one year” for the expressions “two hundred rand” and “six months” respectively (date of commencement 1 October, 1992). 11. Amends section 27 of the National Roads Act, No. 54 of 1971, by adding subsection (3). 12. Substitution for “commission” of “Board”.—The principal Act is hereby amended by the substitution for the word “commission”, wherever it occurs, of the word “Board”. 13. Substitution of certain words and expressions.—The principal Act is hereby amended— (a)by the substitution in sections 7 (3) and 15 (2) for the expression “Secretary for Plural Relations and Development” of the expression “Director-General: Regional and Land Affairs”; and (b)by the substitution in section 19 (6) (a) for the word “both” of the words “all the”. 14. Short title and commencement.—This Act shall be called the National Roads Amendment Act, 1992, and the provisions thereof shall come into operation on a date fixed by the State President by proclamation in the Gazette.
