TRANSPORT GENERAL AMENDMENT ACT NO. 86 OF 1992 [ASSENTED TO 18 JUNE, 1992][DATE OF COMMENCEMENT: 1 SEPTEMBER, 1992] (English text signed by the State President) as amended by Transport Advisory Council Abolition Act, No. 9 of 1996 ACT To amend the Merchant Shipping Act, 1951, so as to delete the power of the Minister of Transport to appoint port welfare committees; to amend the National Road Safety Act, 1972, so as to abolish the National Road Safety Council, and transfer the functions and powers of the council to the Director-General: Transport, who shall perform and exercise them subject to the control and directions of the Minister of Transport; and to amend the Transport Advisory Councils Act, 1987, so as to amend the constitution of the Transport Advisory Council; and to provide for matters connected therewith. 1. Amends section 6 of the Merchant Shipping Act, No. 57 of 1951, as follows:—paragraph (a) deletes subsection (6); paragraph (b) substitutes subsections (8) and (9); and paragraph (c) deletes subsection (10). 2. Amends section 1 of the National Road Safety Act, No. 9 of 1972, as follows:—paragraph (a) deletes the definition of “council”; paragraph (b) deletes the definition of “fixed asset”; paragraph (c) deletes the definition of “Managing Committee”; paragraph (d) substitutes the definition of “Minister”; paragraph (e) deletes the definition of “National Transport Commission”; paragraph ( f ) deletes the definition of “public service”; paragraph (g) deletes the definition of “Republic”; and paragraph (h) deletes the definition of “Road Safety Council”. 3. Repeals sections 2, 3 and 4 of the National Road Safety Act, No. 9 of 1972. 4 to 6 inclusive. Substitute respectively sections 5, 6 and 7 of the National Road Safety Act, No. 9 of 1972. 7. Repeals sections 8 to 13 inclusive of the National Road Safety Act, No. 9 of 1972. 8 to 10 inclusive. Substitute respectively sections 14, 15 and 16 of the National Road Safety Act, No. 9 of 1972. 11. Repeals sections 17, 21, 23 and 24 of the National Road Safety Act, No. 9 of 1972. 12 to 14 inclusive. Substitute respectively sections 25, 26 and 27 of the National Road Safety Act, No. 9 of 1972. 15. Transitional provision.—From the date of the commencement of this section the members of the National Road Safety Council established by section 2 of the National Road Safety Act, 1972 (Act No. 9 of 1972), shall cease to be members of the said council and shall not be entitled in terms of that Act to the payment of any remuneration or allowances. 16 to 25 inclusive. . . . . . . Short title and commencement.—(1) This Act shall be called the Transport General Amendment Act, 1992, and shall come into operation on a date fixed by the State President by proclamation in the Gazette. (2) Different dates may in terms of subsection (1) be fixed in respect of different provisions of this Act.
