URBAN TRANSPORT AMENDMENT ACT

ACT

To amend the Urban Transport Act, 1977, so as to delete, define 
or further define certain expressions; to provide that regional 
services councils will in certain instances be core cities and may 
take over certain functions relating to urban transport; to 
provide for the entering into of agreements with the 
governments of self-governing territories; to extend the general 
powers of the South African Roads Board and its powers to 
utilize funds; to make other provision in connection with the 
appointment of Metropolitan Transport Advisory Boards, and to 
alter the constitution of a board; and to provide for the 
extension of the functions of a core city; and to provide for 
matters incidental thereto.

1.   Amends section 1 of the Urban Transport Act, No. 78 of 
1977, as follows:— paragraph (a) substitutes the definition of 
“Administrator”; paragraph (b) substitutes the definition of 
“approved transport plan”; paragraph (c) deletes the definition 
of “commission”; paragraph (d) substitutes the definition of 
“local authority”; paragraph (e) deletes the definition of 
“National Institute”; paragraph (f) inserts the definitions of 
“roads board” and “self-governing territory”.

2.   Amends section 3 of the Urban Transport Act, No. 78 of 
1977, by substituting subsection (1).

3.   Amends section 4 of the Urban Transport Act, No. 78 of 
1977, by adding subsections (3) and (4).

4.   Inserts section 4A in the Urban Transport Act, No. 78 of 
1977.

5.   Amends section 6 (1) of the Urban Transport Act, No. 78 of 
1977, by inserting paragraph ( fA).

6.   Amends section 10 of the Urban Transport Act, No. 78 of 
1977, as follows:— paragraph (a) substitutes paragraph (b); 
paragraph (b) substitutes paragraphs (e) and ( f ); paragraph (c) 
inserts paragraph ( fA); and paragraph (d ) substitutes paragraph 
(k).

7.   Substitutes section 12 of the Urban Transport Act, No. 78 of 
1977.

8.   Amends section 13 of the Urban Transport Act, No. 78 of 
1977, by substituting subsection (1).

9.   Amends section 17 of the Urban Transport Act, No. 78 of 
1977, as follows:— paragraph (a) substitutes paragraph (g); and 
paragraph (b) adds paragraph (l).

10.   Substitution of word in Act 78 of 1977.—The principal 
Act is hereby amended by the substitution for the word 
“commission”, wherever it occurs, of the words “roads board”.

11.   Short title and commencement.—This Act shall be called 
the Urban Transport Amendment Act, 1990, and shall come 
into operation on a date fixed by the State President by 
proclamation in the Gazette.
